Renter Terms of Use

These Renter Terms of Use (“Renter Terms”) govern your use of the Renta marketplace and all tenant-operated storefronts powered by Renta. By creating an account, making a booking, signing a waiver, or otherwise using the Platform, you agree to these terms and our Privacy Policy.
These Renter Terms govern your relationship with Renta as the technology platform. Your rental transaction is a separate agreement between you and the independent rental business (“Operator”).
1. Platform Role and Disclaimer
Renta is a technology platform that connects consumers with independent rental businesses. Renta does not own, operate, maintain, inspect, or control any rental equipment listed on the Platform. Each Operator is independently owned and solely responsible for its equipment, safety, insurance, and legal compliance.
Renta does not endorse, certify, or guarantee the quality, safety, legality, or suitability of any Operator, equipment, or rental experience. Renta does not verify that Operators maintain valid business licenses, insurance, or safety compliance.
2. Account and Eligibility
You must be at least 18 years old. You must provide accurate information including your full legal name, email, phone number, and — where required — date of birth, address, driver's license number, and emergency contact information. Providing false information may result in account suspension and referral to law enforcement.
3. Booking and Rental Transaction
When you complete a booking, you enter a direct rental agreement with the Operator — not with Renta. Each Operator has its own rental agreement, cancellation policy, and rules. A booking is confirmed when payment is successfully processed.
You agree to: use equipment safely and lawfully; return it in the condition received; report damage immediately; not exceed the rental period; and not sublease equipment.
4. Payments
All payments are processed by Stripe on behalf of the Operator. Your payment card number is handled exclusively by Stripe — Renta stores only the last four digits and brand.
Refunds and cancellations are governed by each Operator's policy, not Renta's. Security deposits may be required and are subject to the Operator's deposit policy.
5. Digital Waivers and Liability Agreements
Many Operators require a digital waiver before your rental. The waiver is a contract between you and the Operator — not Renta. Your digital signature is legally binding under the ESIGN Act. Read the full waiver before signing. If you disagree, cancel the booking instead.
6. Your Personal Information
See our Privacy Policy for full details. By booking, you consent to sharing your information with the Operator. Driver's license numbers are encrypted using AES-256-GCM and access is restricted and audited.
7. Dispute Resolution
7.1 Disputes with Operators
Contact the Operator first. If unresolved, you may request Renta's mediation at support@getrenta.io (non-binding). For payment disputes, use Stripe's chargeback process.
7.2 Disputes with Renta
Attempt informal resolution for 30 days first. Unresolved disputes are subject to binding arbitration under AAA Consumer Arbitration Rules.
CLASS ACTION WAIVER. YOU AND RENTA AGREE THAT EACH PARTY MAY BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Small claims exception: Either party may use small claims court. Opt-out: You may opt out of arbitration within 30 days of your first booking by emailing legal@getrenta.io.
8. Assumption of Risk
Rental activities involve inherent risks of injury, death, and property damage. Renta does not inspect equipment, provide safety training, or supervise activities. You are responsible for independently assessing risks.
9. Limitation of Liability
RENTA IS NOT LIABLE FOR INJURIES, DEATH, PROPERTY DAMAGE, OR FINANCIAL LOSSES ARISING FROM YOUR RENTAL ACTIVITY OR INTERACTIONS WITH ANY OPERATOR. RENTA'S MAXIMUM LIABILITY IS LIMITED TO THE PLATFORM FEES RETAINED BY RENTA FROM YOUR BOOKINGS IN THE PRECEDING 12 MONTHS, OR $100, WHICHEVER IS GREATER. THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
10. Reviews and User Content
Reviews must be honest, based on actual experience, and free of defamatory or discriminatory content. By submitting a review, you grant Renta a perpetual license to use and display it.
11. Account Suspension and Termination
Renta may suspend your account for Terms violations, fraud, or abuse. You may close your account anytime by contacting legal@getrenta.io.
12. Changes to These Renter Terms
We may modify these terms with notice. Continued use after the effective date constitutes acceptance.
13. General Provisions
Governed by the laws of [GOVERNING_LAW_STATE]. Severability, entire agreement, and no agency clauses apply.
